Should Social Media Be Regulated?

Market Failure
The attention economy represents a classic market failure. Self-Regulation Has Failed

The line between "protecting users from harmful content" and "controlling what people can say" is blurry, and governments have a poor track record of drawing it well. Authoritarian regimes already use "online safety" as a pretext for silencing dissent.
Innovation Risk
Heavy-handed regulation could stifle the next generation of tech startups. If compliance costs are too high, only the largest companies — the ones that already dominate — will be able to afford them. Regulation could inadvertently entrench the monopolies it aims to constrain.
Jurisdictional Complexity
The internet is global. Social media platforms operate across borders. National regulations create a patchwork of rules that are difficult to enforce and easy to circumvent. Without international coordination, regulation risks being ineffective or creating a fragmented internet.
A Middle Path
The most promising approaches focus not on content moderation but on design regulation. Instead of telling platforms what users can or can't post, regulators can ban manipulative design practices — dark patterns, algorithmic amplification of harmful content, infinite scroll for minors, and surveillance-based advertising.
